WHITEHALL -- Former Phish frontman Trey Anastasio was arrested by village police early this morning and charged with DWI-drugs after they stopped his car for failure to keep right.

Ernest J. Anastasio was stopped at 3:30 a.m. by Patrolman Andrew Mija who said the musician was observed to be under the influence of a narcotic substance after failing field testing, Patrolman Jeff Whalen said this morning.

Anastasio lives in Vermont, which is just over the border from this Washington County community. Whalen said he had a suspended driver's license in New York and allegedly was found with an assortment of prescription medications including hydrocodone, Percocet and Xanax, which were prescribed for another person.

Anastasio was charged with third-degree aggravated unlicensed operation, seventh-degree criminal possession of a controlled substance and DWI - drugs, Whalen said. He was released on from custody with appearance tickets for a later date.

Anastasio, who is pursuing a solo career since Phish broke up, is scheduled to appear at the Palace Theatre in Albany on Dec. 29.

In an interview with the Times Union last year, Anastasio discussed the role drugs played in the band's final years, and in his decision to call for its end.

While fatigue was generally seen as the culprit, few fans were willing to chalk it up to anything more than artistic torpor or mundane road-weariness after the band's breakup announcement in May 2004.

``I thought it went without saying how deep into our scene hard drugs had gone,'' said Anastasio in the November 2005 interview. He resisted getting into the specifics of who was doing what, and how much.

``That's why I was surprised at people saying, `How could you do this?' How could I not do this? What's the alternative here? I always thought our scene was so transparent, that everybody knew everything. That's why it was hard to hear the anger and frustration from Phish fans,'' he said.

``I just want to say to them: I love Phish, too. But because of what was happening to Phish and happening to me, the decisions came from a place of love and respect for the same thing that you all loved and respected. That same light was going out pretty damned fast.''

``We got through the '80s and '90s without encountering hard drugs which is pretty miraculous considering what those eras were like and it is a testament to the guys in the band, in how intent we were from keeping those type of drugs away.''

``Once we let our guard down around 1998, the scene started to eat itself and there was a massive loss of perspective. ... The whole thing was being crushed under its own weight. The germ of the thing that feeling between the four of us is still there, but we were getting unhealthy and tired,'' he said.

The band went on hiatus in the fall of 2000, and didn't return to the road until the end of 2002. ``We came back and it was even worse,'' Anastasio said.

The summer 2004 tour ended with the band's weekend-long August farewell on farmland outside of Coventry, Vt.

He drugged himself out of playing coherent, quality music a while ago...not a huge shock really. Poor guy...he should just retire \"for awhile\" and focus on healing his life.

That's a bummer. Even though I wasnt a huge fan of his new stuff, I at least thought he was over the drugs. Good luck Trey. Some of us have been down that road.

Phish frontman pleads guilty to drug charge

FORT EDWARD, N.Y. -- Former Phish lead singer Trey Anastasio pleaded guilty this morning to fifth degree attempted criminal possession of a controlled substance in Washington County Court.

Anastasio, 42, a part-time Richmond resident, was ordered by Judge Kelly McKeighan into drug treatment court and his sentencing was postponed until he completes or fails the program.

\"If he fails, he would be sentenced to 1 to 3 years in state prison. If he succeeds, he would be sentenced to 5 years probation,\" McKeighan said.

The guilty plea comes four months after a Whitehall, N.Y., police officer pulled over Anastasio's 2004 Audi for failing to keep right as he drove north on U.S. 4 at about 3:30 a.m. on Dec. 15, according to court papers. He failed a sobriety test and was taken into custody. He subsequently pleaded not guilty to a seven-count indictment that included three felonies and carried a possible prison sentence of up to 14 years.

With the plea agreement, Anastasio also agreed to wave his right to appeal. Because this is a felony conviction, should he be convicted of any other felony in next 10 years, that would require a mandatory prison sentence.

Anastasio refused to comment to media assembled outside the courthouse, saying only \"Sorry,\" as climbed into a black limousine van as he departed.

Anastasio will relocate from New York City, where he lives with his wife and two children, to Washington County for at least the first three months of the drug treatment program, his attorney, Steve Coffey, said. He faces random drug testing on any day.

What I find interesting is how cool it is now to rag on trey and phish..but trey has a problem that happens to be the same problem that took away one of the most beloved musicians of all time -Jerry. I do not remember hearing a lot of **** about Jerry when he was clearly addicted and especially after his death. Do we really want to lose another musican that has helped influence this music and community that we all seem to be pretty strong into. Wouldn't it be better to have more positive vibes for Trey. I would rather him beat this thing and have several more years of his great talent than to watch him give his life away. Would you be ragging on one of your friends if they had an addiction problem? We have lost so many great artists to this **** do we really need to lose Trey? just my .02

He even said that one of the reasons it progressed so far in his life is because he \"employs most of his friends\" which means they were constantly giving him \"positive vibes\" and not the hard reality of what addiction is all about. Personally, I feel his addiction was reflected clearly in his music as well, which means he was delivering a 1/2-ass product to the folks paying 30+ dollars to see him. Addicts need to hear, over and over, that being an addict is \"the idiot's path\" and will, duh, lead to failure and death. Coddling the poor bastard doesn't do anything. Expressions of disgust at his choices on the Waka message board are hardly the same as going to his personal webpage and haranguing him there.

I think you are missing my point...there are ways to support someone that needs help other than just calling him a \"loser\" or a \"dumb ass\". Never did I say anything about Coddling him either...I guess I have not seen 1st hand by beating someone down will help them with their issues. I just find it interesting that it is now cool to hate on phish and Trey. Of course I know on message boards people will talk all the **** they want then they will be 1st in line if Phish toured again.

Most of the people that rag on him still have a bad taste in their mouth from the Phish breakup. Most of those same people blame him and his addiction for the demise of one of the greatest bands of our time.

Don't get me wrong.....I hope he DOES get better because when he wasn't into that hard ****, the music was far better than it is today. And from the couple of hours I spent talking to him on the plane, I can tell you he's a pretty damn nice guy, too. I hate to see good people go down the path of destruction.

He just needs somebody to slap the piss out of him so he'll wake the **** up and realize what he's doing to his life. Maybe this conviction IS that slap that he needs.

It just depends on how well you know the person. I doubt any of you have been within 5 feet of Trey (Pauly aside). It's easy to call someone a dumbass on the computer, when the only time you have heard that person speak is when he's 50 rows in front of you singing the lyrics to his song.

One of my good friends checked herself into rehab about 3 weeks ago. In her case, I would never use any words like Dumbass or retard or jamtard (hehe) to describe how she handles her problem. She knew she had a problem, and she got help herself. She is smarter than Trey for that reason.

But still, if you were a good friend of Trey's and you knew he had a serious problem like this, I doubt you would think he needs any more negative feedback.

I'm not going to pick sides even if I sound biased. People on both sides of the line are making good points.

we all have our problems and addictions. i wish the anastasio family the best. trey has given me some of the best shows and times of my life(big cypress to name one). all you haters would jump on the band wagon (no pun intended) the second phish goes back on tour. i'm know for a fact his family has sufferd alot as all families do when someone is wrapped up in the neverending drug strugle. just shoot some positive vibes treys way and they will come back to you in one form or another. peace my friends! :D
